As I noted in Xie v. Lai, 2021 BCSC 2128, a trial involving these parties was originally set to be heard over 40 days, commencing on September 27, 2021. After much procedural wrangling, the trial ultimately commenced on October 12, 2021, for 4 days concerning only the three above-noted defendants. At the commencement of trial, counsel advised that a settlement has been reached with the remaining defendants and the issues had been significantly reduced. The 40-day trial was therefore reduced to 4 days.

The procedural issues which had impacted this litigation from the outset continued to arise as the trial commenced. The three remaining defendants did not appear at the commencement of trial on October 12, 2021. On the second day of the trial however, the defendants appeared and sought an adjournment. I initially granted a short adjournment of the trial until October 25, 2021. The reasons for that adjournment and much of the background in this matter is set out in Xie v. Lai, 2021 BCSC 2038.
