Whether leave to appeal should be given is a more difficult question. It seems clear that the court is vested with an unfettered discretion in granting or refusing the leave to appeal. The matters which should be considered in such an application as this were set out by this court in its judgment in White v. Reg. 1946 CanLII 172 (SK CA), [1946] 2 WWR 337.
