The question of whether an order can be varied based on subsequent events was considered by Fleming J. in McLachlan v. McLachlan, 2013 BCSC 1733. In that case, the respondent sought a variation of an order regarding distribution of sale proceeds of the matrimonial home because the value of the home increased substantially after the order and before sale.
