The Minnesota court distinguished the leading case of Zurcher v. Stanford Daily (1978) 436 U.S. 547, 98 S.Ct. 1970, 50 L.Ed.2d 525, on the ground that in Zurcher, the constitutionally permitted search of the third party newspaper office was acceptable in that the newspaper had announced a policy of destroying relevant evidence that might aid in prosecution of demonstrators.
