33 "[T]he question of whether a person is an aider and abettor in the commission of a crime is one of fact." (People v. Conely (1975) 48 Cal.App.3d 805, 808, 123 Cal.Rptr. 252.) In this respect, it is similar to the issue of whether a killing was committed "in furtherance of" the burglary attempt and involves a "factual determination of the committing magistrate."
