evidence' is limited to where the newly discovered evidence relates to the elements of the crime charged" and does not extend to evidence of counsel's effectiveness. United States v. Hanoum, 33 F.3d 1128, 1130 (9th Cir. 1994). Although such evidence may be material to the effectiveness of counsel, it is not material to a defendant's guilt or innocence. Id. at 1130-31. Accordingly, none of Love's ineffective assistance of counsel claims are based on newly discovered evidence for the purposes of Rule 33 and thus cannot justify the granting of a new trial motion filed more than 14 days after the verdict. See Harrington, 410 F.3d at 601.
