The following excerpt is from Martinez v. Flagstar Bank, No. 2:15-cv-01934-KJM-CKD (E.D. Cal. 2016):
"Causes of action for . . . intentional infliction of emotional distress are governed by the two-year statute of limitations set forth in Code of Civil Procedure section 335.1." Pugliese v. Super. Ct., 146 Cal. App. 4th 1444, 1450 (2007). For the same reasons described in the previous section, the complaint does not include sufficient factual allegations to show the claim accrued within the two-year limitations period. The claim for intentional infliction of emotional distress is dismissed with leave to amend.
