6 Actually, the plaintiff first filed a legal malpractice action in 1983, but after the court denied his motion to extend the five-year statute for bringing it to trial ( 583.310), he dismissed it. (Finlayson v. Sanbrook, supra, 10 Cal.App.4th at p. 1439, 13 Cal.Rptr.2d 406.) That aspect of the procedural history is irrelevant to our discussion.
