1 We affirmed the dismissal of Brigaerts' other claims, including denial of access to justice, in a previous appeal. We vacated the dismissal of his claims for damages for deliberate indifference to medical needs and conditions of confinement and remanded to provide him with an opportunity to amend his complaint to allege harm in connection with those claims. Brigaerts v. Cardoza, No. 91-15437, unpublished memorandum decision (9th Cir. Jan. 9, 1992). On remand, Brigaerts failed to amend his complaint.
