In Weber v. DeBrouwer, the 49-year old plaintiff suffered injuries as a result of an assault and battery. The defendant confronted the plaintiff about something and when the plaintiff tried to walk away the defendant punched the plaintiff in the face. The plaintiff told the defendant to stop or he would have him charged, and the defendant then struck the plaintiff again and knocked him to the ground. The plaintiff was repeatedly punched in the head and was kicked. The defendant restrained the plaintiff by wrapping an arm around the plaintiff’s head while using the other to punch the plaintiff in the face.
