Both of the above decisions were referred to in Wang v. Yu, 2017 BCSC 1076, where there were claims for the repayment of monies based on various causes of action including breach of contract, fraudulent conveyance or preference and unjust enrichment: paras. 13-16, 27. The claim, as plead, was found sufficient to support the registration of a certificate of pending litigation based on an interest in land under a constructive trust, presumably on the basis that causes of action were alleged other than one based on repayment under contractual rights alone: paras. 29-40.
