Then once the motion for leave is launched, the timing of the hearing is only partially within the control of the moving party. For example, the defendants may initiate procedural steps that could cause delay. As well, court availability can affect the timing of the hearing and the decision. In Silver v. IMAX, the leave motion had been argued and was under reserve when the limitation period expired.
