The following excerpt is from R. v. Caza, 2012 BCSC 525 (CanLII):

The third case is United States v. Soderholm, 2011 U.S. Dist. LEXIS 130727 (D. Neb. November 9, 2011). Again, the court found that despite the nature of a P2P network that allowed you to select your own contacts, the court found that the accused did not have a reasonable expectation of privacy for those files which he was sharing with “friends” on this private network. The files were no longer kept private and the accused could not control what the “friends” might do with the files.
