Our Supreme Court in Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 SCR 235, summarized the applicable standards for appellate review. In Housen, the majority confirmed that questions of law are reviewable on a correctness standard and on pure questions of law, an appellate court is free to replace the opinion of the trial judge with its own: para 8.
