In this particular case, the skiff was used in the commission of the offences. It did not have a registration number. It was purposely placed at risk of forfeiture. As pointed out in Turner v. Manitoba, 2001 MBCA 207, the penalty imposed by way of forfeiture “will always be an amount that the accused chose to put at risk when he or she chose to commit the offence” (at page 264).
