P. 53; 8 C.B. 565; 137 E.R. 629, at p. 638, Maule, J. said: The reason that the sheriff is held liable is, that, having a duty imposed upon him by law, instead of performing it himself, he delegates it to another; and therefore it is but just that he should be responsible for the misconduct of those to whom he so delegates the performance of his duty.
