The following excerpt is from Barsi v. Farcas; Nadge (Garnishee), 1923 CanLII 299 (SK QB):

Dealing with the second ground of objection, I am doubtful of this being a good ground for setting aside the garnishee summons. This raises a question which in my opinion The Attachment of Debts Act contemplates should be disposed of in another way, either summarily or upon an issue. (See my judgment in Hallson v. Brounstein, supra). I prefer, however, notwithstanding this opinion to deal with the question raised.
