Two difficult questions arise in connection with the trial. The one is the matter of domicile, and also whether the plaintiff can be held to have proved, in the evidence submitted, the allegation of adultery (as required by the decision in Ginesi v. Ginesi [1948] P 179, [1948] LJR 892 [C.A.]) with the same degree of strictness as is required to establish a criminal charge.
