Given that the schedule remains the same, I am not prepared to embark on a “time accounting analysis” of the sort questioned in Berry v. Hart, 2003 BCCA 659 at para. 10, in an effort to determine whether the father spends 38 percent or 43 percent of his time with the boys. Making a reliable finding on that point would be very difficult given the multitude of credibility issues arising from the parties’ affidavits and other material. In any event, it is my view that both figures could justify the finding of Koenigsberg J. that there is close to shared custody.
