Anyone who is arrested or detained must be informed of his or her rights to counsel under section 10(b) of the Charter. This “informational” right includes an obligation to advise a detainee how to contact duty counsel and legal aid: R v. Bartle, 1994 CanLII 64 (SCC), [1994] 3 S.C.R. 173, at paras. 21 to 23.
