In Olafson v. British Columbia (Superintendent of Motor Vehicles) 2000 BCSC 771, Mr. Justice Melvin considered the issue of whether the reviewing officer is an independent and impartial decision maker as guaranteed by s. 7 of the Charter or as required by the fundamental principles of natural justice. He concluded that the Superintendent did have security of tenure so as to ensure independence in that context.
