It is submitted that the interest affected in this case is purely economic. The fact that the Respondent may receive a smaller retirement pension as a result of her inability to access a credit split does not amount to being denied access to a “fundamental social institution” or by missing the limitation period it cannot be viewed as impacting a “basic aspect of full membership in Canadian Society” or “a complete non-recognition of a particular group” as expressed in Law v. Canada (Minister of Employment and Immigration)[14].
