In United States of America v. Drysdale, the purpose of an “Authority to Proceed” under s. 15 of the Act was discussed at p. 180. The purpose is twofold: First, it is analogous to the information or indictment in a domestic prosecution and thus gives notice of what is alleged against him or her; and forms the basis of an order committing the person for extradition where such an order is made. Second, the authority to proceed ensures that the Minister’s decision to authorize the seeking of committal on behalf of the requesting state is made in a timely way.
