The purpose of a certification motion is to determine how the litigation is to proceed and not to address the merits of the plaintiffs’ claim. The evidentiary requirement for certification is low – the plaintiffs need only show “some basis in fact” for each of the certification requirements in s. 5(1), other than the requirement in s. 5(1)(a) that the pleading discloses a cause of action: Hollick, at paras. 16, 25; Boulanger v. Johnson & Johnson Corp., [2007] O.J. No. 179 (S.C.J.) at para. 20, leave to appeal denied, [2007] O.J. No. 1991 (Div. Ct.)., supplemental reasons, [2007] O.J. No. 2043 and [2007] O.J. No. 2766 (S.C.J.).
