Factors relevant to whether it is in the public interest to accept a complaint may include, among others, the length of the delay, the reason for the delay, and the public interest of the complaint itself: Fontaine v. Ainsworth Lumber, 2005 BCHRT 565, para. 21. Contrary to the District’s submission, a complainant’s explanation need not necessarily be “compelling and convincing”: Fontaine, paras. 8 - 21.
