My research has turned up only a few Canadian cases that have addressed the private insurance exception in the context of property damage claims. I asked for and received additional written submissions on these cases. Perhaps the most noteworthy is Strachan v. Constant Craving (Ship), 2003 FCT 86. In that case, the plaintiffs’ pleasure boat was badly damaged while moored at a Richmond marina. The damage was caused by the explosion of a nearby vessel.
