The presence of expert evidence in an action against a professional such as a physician is the norm. Conduct that accords with well recognized and acceptable professional practice will usually, but not necessarily, defeat an allegation of negligence (see ter Neuzen v. Korn, 1995 CanLII 72 (SCC), [1995] 3 S.C.R. 674). I see no basis to elevate an operator of a hotel and commercial complex to the level of a professional exercising his or her skill in a specialized or technical area. There was nothing technical or specialized about the conduct in this case.
