The appellants contend that a plea of detrimental reliance, required for example in a valid plea of negligent misrepresentation (Queen v. Cognos Inc., 1993 CanLII 146 (SCC), [1993] 1 S.C.R. 87), is missing from the pleading. The requirement of detrimental reliance, of course, condenses the requirement of reasonable reliance and the requirement that the reliance was to the detriment of the claimant (Cognos at 110).
