In this case I note that what is being sought here is more than blood or urine testing, as was the nature of the order made in the decision of Siemens v. Motruk, [2002] 11 W.W.R. 399 (S.C.) which was referred to by counsel in their submissions. It is more than rebuttal evidence. Its purpose is to determine if there is evidence of a new possible contributing cause to the plaintiff's condition, in particular the plaintiff's cognitive and executive functioning.
