The plaintiff relied upon the decision of Wong J. in Ryon v. Whitehouse, 2008 BCSC 1090, where the decision of Masuhara J. in Amador v. Hans, 2004 BCSC 348 (reversed on the issue of damages only at 2005 BCCA 514) was followed. In each of those cases the driver who had gained the right to proceed with caution was held only 10% to blame for failing to appreciate the speed and proximity of oncoming traffic.
