The motion judge did not accept that submission. He held, at para. 31: Based on the facts in [Armitage v. The Salvation Army, 2016 ONCA 971 (CanLII), 406 D.L.R. (4th) 563], Hourigan J.A. found that the passing of accounts does not fit within the definition of a claim within the Limitations Act, 2002. In my view, if the passing of accounts does not constitute a claim, I am not satisfied that a Notice of Objection is a claim.
