In determining whether the disciplinary sanction falls within an appropriate or reasonable range of penalties we, like the hearing panel, have considered the factors set out in Law Society of BC v. Ogilvie, 1999 LSBC 17 (the “Ogilvie Factors”). The hearing panel found that this was not a case where it was appropriate to consider an abridged version of the Ogilvie Factors. We have likewise also considered all of the Ogilvie Factors.
