Easements are contractual documents. They must be interpreted in accordance with the plain and ordinary meaning of the words in the grant to determine what the intention of the parties was at the time the grant was made: Robb v. Walker, 2015 BCCA 117 at para. 31.
It is appropriate to consider surrounding circumstances in interpreting a contract, even when the ordinary meaning of the words used does not give rise to ambiguity: Dodsworth v. Madill, 2019 BCSC 898 at para. 25.
