In Strata Plan N38 v. Charmglow Products [1987] B.C.J. No. 2776 (B.C.S.C.) a distributor had imported and sold a barbecue kit that required assembly. The kit was shipped in a sealed box. The design of the barbecue permitted placement of the propane fuel tank on a shelf located directly under the barbecue itself. The manufacturer supplied a 3-foot hose to connect the tank with the flame unit rather than a 12-foot hose as specified in the manual. Because of the location of the tank and the short hose a fire resulted when the barbecue was used. The plaintiffs sued the manufacturer and the distributor of the barbecue.
