Counsel for the Lawyer referred to cases in which as a result of extenuating and extraordinary circumstances, members were permitted to resign as opposed to being disbarred. He referred in particular to paragraph 71 in the decision of Law Society of Upper Canada v. Winton, [2007] L.S.D.D. No. 110, where examples of cases involving extenuating and extraordinary circumstances are set out.
