I note, however, that in his affidavit the assistant warden said “many complaints or grievances related to missing or damaged inmate property”, although some complained the searches were excessive (including one inmate who complained he had been searched four times and this was “too much”). It is clear from this that the grievance process is not an avenue for seeking redress of the type sought in this action. This case does not involve complaints of missing or damaged property or, as in the case referred to by the defendant, allegedly offensive t-shirts worn by prisoners on “Prisoner Justice Day” (Lauzon v. Canada (Attorney General), 2014 ONSC 2811). This case involves questions of alleged wrongs visited upon the entire inmate population at a correctional institution by those in charge of the facility.
