No detailed analysis is required to support the conclusion that the impact of these violations on the accused’s rights to privacy and liberty was of a high degree of seriousness. Moreover, none of the evidence obtained against the accused would have or could have been obtained by other, lawful means. That is a fact which tends to aggravate the impact of the violations on the Charter-protected rights of the accused. See R v. Cote 2011 SCC 46; [2011] 3 SCR 215, at paras 72-73.
