Is a claim for private education for the children of the Husband's parents valid?

Ontario, Canada

The following excerpt is from Kochar v. Kochar, 2014 ONSC 3220 (CanLII):

As to the claim for private education of the children, this is a gift totally funded by the Husband’s parents and is withdrawable by them at any time. Accordingly, based on the reasoning of Cusinato J in Stoyshin v. Stoyshin this is not income imputable to the Husband.
