The Guild Yule defendants also seek special costs. This is in my view one of those cases where special costs is warranted. This is not a case of a lay litigant simply being confused about the Rules. The plaintiff here is well versed in litigation, as was noted by our Court of Appeal in Keremelevski v. Insurance Corporation of British Columbia, 2011 BCCA 369. He well knows that there are consequences for taking steps in legal proceedings and sometimes those consequences result in costs being ordered.
