The father also seeks to go behind the agreement to terminate spousal support as of February 1, 2001 and now wishes to argue it should have been terminated when the mother remarried in 1999. However, he had an agreement with the mother to terminate spousal support at a certain date and there is no evidence that this agreement was unfairly negotiated or inconsistent with the objectives of the Divorce Act (see Miglin v. Miglin, 2003 SCC 24; [2003] 1 S.C.R. 303), therefore, there is no reason to look beyond their agreement.
