The elements required to be proven to establish a claim in negligent misrepresentation were set out in Queen v. Cognos Inc., 1993 CanLII 146 (SCC), [1993] 1 S.C.R. 87. The five elements are as follows: (i) the person or entity making the representation must owe the recipient of that representation a duty of care; (ii) the representation must be untrue, inaccurate, or misleading; (iii) the person making the representation must have acted negligently; (iv) the recipient must have relied, in a reasonable manner, on a negligent misrepresentation; and (v) there must be some detriment suffered as a result of that reliance in the sense that damages resulted.
