In 1997, a group of petitioners asked the court to set aside the December 1996 election because the election process, which had been in place for a number of years, did not permit a secret ballot (Nagra et al v. The Khalsa Diwan Society of Victoria, 1997 CanLII 3229 (B.C.S.C.)). Ultimately, Bouck J. validated the election but directed that the society and its members conduct the next election “in accordance with its bylaws as they now stand or in accordance with any lawfully amended bylaws that may exist at the time of the 1997 Annual General Meeting” (para. 22).
