What factors are considered to be determinative in determining whether a person will be successful in their claim to be a property owner?

Ontario, Canada

The following excerpt is from Stoiantsis v. Spirou, 2008 CanLII 1667 (ON SC):

In reaching these conclusions, I have relied upon several factors. No one factor, standing alone, is determinative. Rather, I base my findings on the cumulative effect of these considerations. In this regard, my analysis is not dissimilar to that undertaken by Quinn J. in Gill Estate v. Marriot [1999], O.J. No.4509 at paras. 29-72.
