Based on the decision in Coho Creek Estates v. The District of Maple Ridge, supra, it may be that some or all of the intervenors who received building permits after the by-law was passed, but who had submitted either development permit applications or building permit applications, would not be subject to the levy, regardless of the severance of subsection 3(b), but that is not an issue before us.
