In terms of conspiracy, the courts have held that the tort occurs where the harm has occurred, regardless of where the wrongful act took place: British Columbia v. Imperial Tobacco Canada Ltd., 2006 BCCA 398 at para. 41. Furthermore, once jurisdiction over any wrong, including conspiracy, is established, all defendants potentially liable to the plaintiff are properly joined in the action. This includes ex juris defendants who are alleged to be parties to a conspiracy.
