Pursuant to section 15.2(5), the court is forbidden to take into account any marital misconduct on the part of the other spouse when making an order for support. That said, the emotional consequences that flow from such misconduct, as distinct from the misconduct itself, may be “highly relevant” to the factors that are to be considered in determining the entitlement, duration and amount of support, particularly the spouse’s ability to earn income and achieve economic self-sufficiency: Leskun v. Leskun, 2006 SCC 25 at para. 21.
