The plaintiff’s evidence as to the degree by which a judge-alone trial would likely shorten the trial estimate lacked precision. However, it is recognized that by their nature, civil jury trials take longer than civil judge-alone trials and, since they take longer, the parties incur more legal expenses: Louis v. Poitras, 2020 ONCA 815 at para. 68.
