In Nadig v. Scoffield, 2003 BCSC 1218, Mr. Justice Taylor dealt with an assault that was alleged to have been committed on the plaintiff by his lawyer when the two had a dispute over the former’s file at the lawyer’s office. The client’s civil claim was dismissed on the basis that the medical evidence did not support the client’s allegations as to how his injuries occurred, and was refuted by the evidence of the lawyer’s secretary and his partner.
