Is a dispute arising out of a collective agreement?

Manitoba, Canada

The following excerpt is from Billinkoff v. Winnipeg School Division no.1, 1999 CanLII 14067 (MB CA):

41 In Weber v. Ontario Hydro, McLachlin J. makes it clear that a dispute will be held to arise out of the collective agreement if it falls under the collective agreement either expressly or by inference. In my view, the present dispute does not emerge out of any of the collective agreements, even inferentially.
