Generally, all of the terms and conditions of the employment relationship between an employer and unionized employees are found within the four corners of the applicable collective agreement, but as I noted in Bennett v. British Columbia, 2007 BCCA 5, 277 D.L.R. (4th) 440 at para. 69, “the law does not preclude parties from agreeing to exceptions or prevent a legislature from legislating exceptions”.
